Disclaimer (ENGLISH VERSION) – Currency Information, No Investment Advice, and Limitation of Liability

This website (the “Site”) and all information, data, tools, and other content made available through it (collectively, the “Information”) are provided subject to this Disclaimer. By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by this Disclaimer. If you do not agree, you must not use the Site.

This Disclaimer is intended to be read together with our Terms of Use, Privacy Policy, Cookies Policy, and any other legal notices available on the Site (collectively, the “Legal Documents”).

1. General informational and reference purposes only

1.1. The Information is provided strictly for general informational and educational purposes, including as a reference for indicative foreign exchange (“FX”) rates, market data, and related analytics.

1.2. The Information is not tailored to the circumstances of any particular person or entity and may not be suitable for your specific situation, objectives, risk tolerance, or needs.

1.3. No legal right, expectation of performance, or guarantee of outcome arises from your use of the Site or reliance on the Information.

2.1. Nothing on the Site constitutes, and must not be construed as:

  • investment, trading, portfolio-management, or wealth-management advice;

  • legal, tax, accounting, regulatory, or compliance advice;

  • a personal recommendation or opinion on the value or suitability of any currency, security, derivative, financial instrument, or strategy.

    2.2. Under EU law (including MiFID II), “investment advice” generally involves a personal recommendation presented as suitable for a specific person or based on that person’s circumstances. The Information on this Site is generic and addressed to the public; it is not a personal recommendation within that meaning.

    2.3. Under U.S. law, the definition of an “investment adviser” generally requires, among other elements, that a person for compensation be in the business of providing advice about securities. The Site operator does not hold itself out as providing individualized investment advice or investment adviser services.

    2.4. You remain solely responsible for your own decisions. Before making any financial, investment, legal, tax, or business decision, you should consult appropriately qualified professional advisers (for example, a licensed investment professional, attorney, or tax adviser) in your jurisdiction.

3. No offer, no solicitation, no recommendation

3.1. The Site and the Information do not constitute and must not be treated as:

  • an offer to buy or sell any currency, security, derivative, financial instrument, or service;

  • a solicitation of an offer to buy or sell any such instrument or service;

  • a recommendation, invitation, or inducement to enter into any transaction;

  • marketing, “general solicitation,” or “general advertising” within the meaning of applicable securities or financial-services laws.

    3.2. Unless expressly stated otherwise in a separate agreement, the Site does not itself execute currency exchange transactions, money transfers, or regulated payment services, and is not presented as a payment institution or investment firm under EU, U.S., or Ukrainian law.

4. Nature of currency data (indicative, mid-market, differences from transaction rates)

4.1. FX rates, indices, charts, analytics, and related figures displayed on the Site may be:

  • indicative and not executable prices;

  • based on third-party sources, public feeds, or vendor data believed to be reliable but not independently verified;

  • calculated using different methodologies (e.g., mid-market, reference, composite, or vendor-specific formulas);

  • delayed, rounded, interpolated, or subject to revisions.

    4.2. Actual rates available to you from banks, payment providers, card networks, brokers, or other institutions may differ significantly from the rates displayed on the Site due to spreads, fees, commissions, taxes, market depth, volatility, and other factors.

    4.3. You must not assume that any rate shown on the Site is the rate at which you can or will transact (buy, sell, send, receive, or convert) in practice.

5. Accuracy, completeness, and availability – “as is” and “as available”

5.1. Although reasonable efforts may be made to provide accurate and up-to-date Information, the Site operator does not guarantee and makes no representation or warranty (express, implied, statutory, or otherwise) that:

  • the Information is accurate, complete, current, or free from errors or omissions;

  • the Site will be available at any given time, uninterrupted, secure, or free from defects, viruses, or other harmful components;

  • any identified error, inaccuracy, or defect will be corrected.

    5.2. The Site and the Information are provided on an “as is” and “as available” basis, without any warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by applicable law.

6. User responsibilities

6.1. You are solely responsible for:

  • independently verifying any FX rate, figure, or calculation before using it for any financial, commercial, accounting, tax, reporting, or regulatory purpose;

  • evaluating the risks of any transaction, strategy, or decision that references or uses the Information;

  • ensuring that your use of the Site complies with all laws, regulations, and rules applicable in your jurisdiction, including consumer-protection and financial-services rules.

    6.2. You should treat the Information as one input among many and not as a definitive or authoritative source for contractual, accounting, or regulatory purposes.

7. Regulatory, sanctions, and jurisdictional considerations

7.1. The Site must not be used to plan, facilitate, or execute any activity that would violate:

  • applicable financial-sanctions, anti-money-laundering (AML), counter-terrorist-financing (CTF), or currency-control regimes;

  • trade-embargoes, export-control regulations, or other restrictive measures;

  • consumer-protection or unfair commercial-practices laws, including those of Ukraine and the European Union.

    7.2. The Site operator may, at its discretion, restrict access where required by law, including in relation to sanctioned persons, territories, or activities.

8.1. The Site may display or rely on data, content, tools, or services provided by third parties (including market-data vendors, public institutions, and other websites), or may contain links to third-party websites.

8.2. Such third-party content is provided solely for convenience on an “as is” basis. The Site operator does not control, endorse, audit, or assume responsibility for any third-party content, including its accuracy, lawfulness, security, or availability.

8.3. Your use of any third-party sites, tools, or services is at your own risk and subject to their own terms, conditions, and privacy policies.

9. Forward-looking statements, models, and hypothetical scenarios

9.1. From time to time, the Site may include forward-looking statements, projections, hypothetical scenarios, stress tests, or model outcomes (for example, to illustrate possible currency movements or potential costs).

9.2. Such statements are inherently uncertain, based on assumptions that may not occur, and are subject to risks and external factors beyond the Site operator’s control. Actual outcomes may differ materially.

9.3. Forward-looking or hypothetical Information must not be relied upon as a prediction, guarantee, or promise of future performance, events, or results.

10. No fiduciary, advisory, or client relationship

10.1. Your use of the Site does not create any client, advisory, fiduciary, agency, partnership, or other special relationship between you and the Site operator or its affiliates.

10.2. The Site operator does not owe you any fiduciary duty, duty of best execution, or best-interest obligation with respect to your use of the Site or the Information.

11. Limitation of liability

11.1. To the maximum extent permitted by applicable law, neither the Site operator nor its affiliates, directors, officers, employees, contractors, or data providers shall be liable for any loss or damage of any kind arising out of or in connection with:

  • your access to, use of, or inability to use the Site or the Information;

  • any decision made or action taken (or omitted) in reliance on the Site or the Information;

  • any error, omission, interruption, defect, delay, system failure, virus, or loss of data;

  • any third-party content, website, product, or service accessed via links from the Site.

    11.2. This limitation of liability applies to all types of damages, whether direct, indirect, incidental, consequential, special, exemplary, or punitive (including, without limitation, loss of profits, revenue, business, goodwill, data, or anticipated savings), even if such damages were foreseeable or the Site operator was advised of their possibility.

    11.3. Nothing in this Disclaimer is intended to exclude or limit any liability that cannot be excluded or limited under mandatory provisions of applicable law, including consumer-protection law in Ukraine, the European Union, or the law of your country of residence.

12. Mandatory consumer rights (EU, Ukraine, and other jurisdictions)

12.1. If you qualify as a consumer under the laws of Ukraine, the European Union, or another jurisdiction, you may have specific statutory rights that cannot be excluded or limited by contract.

12.2. Nothing in this Disclaimer is intended to prejudice or restrict any such mandatory consumer rights (for example, rights relating to unfair commercial practices, misleading information, or defects in digital services). Where there is a conflict between this Disclaimer and mandatory provisions of applicable law, the latter shall prevail.

13. Changes to the Site, the Information, and this Disclaimer

13.1. The Site and the Information may be modified, updated, suspended, or discontinued at any time, with or without notice.

13.2. This Disclaimer may also be updated from time to time. The version posted on the Site at the time of your access governs your use. Your continued use of the Site after any change constitutes your acceptance of the revised Disclaimer.

14. Language versions and precedence

14.1. This Disclaimer may be provided in multiple languages. In case of any inconsistency of interpretation or translation, the English version shall prevail, except where prohibited by mandatory provisions of applicable law.

14.2. Any non-English version is provided solely for convenience and does not create additional rights or obligations.
